The offers of this Web Shop and Website are intended only for consumers as defined by the Federal Ministry of Food, Agriculture and Consumer Protection (BMELV) and Consumer Protection Act (KSchG). Therefore, when purchasing products from the Web Shop or Website, the customer enters into a legal transaction for a purpose that cannot be attributed to the customer’s commercial or self-employed activity.

Orders placed in the Web Shop or on the Website will only be accepted in German and English from customers with a legal capacity to make transactions and who reside within the territory of the Federal Republic of Germany, the Republic of Austria or Switzerland.

All products and services offered in the Web Shop are without obligation. By clicking the button “SUBMIT ORDER” at the end of the order transaction, the consumer is placing a legally binding order for the products contained in the shopping cart and is thereby commissioning CHANNOINE to execute the order as expeditiously as possible.

CHANNOINE shall promptly acknowledge receipt of the electronic order to the customer, first directly on the electronic display and then time-delayed by e-mail.

The customer shall check the order confirmation for accuracy and completeness, and shall immediately contact CHANNOINE customer service in case of discrepancies.

A contract for the delivery of goods is only concluded through an explicit acceptance of the order by CHANNOINE or through delivery of the goods. If the customer fails to receive an explicit order confirmation or delivery of goods from CHANNOINE within two weeks of placing a binding order then the customer is no longer bound by the order.

Deliveries are dispatched within one to three working days after receipt of an order and confirmation of valid payment.

In the event that ordered goods are no longer deliverable, CHANNOINE is entitled to not perform the service (right of “self-delivery”). In such an instance, CHANNOINE is obligated to inform the customer without delay about the non-availability of the goods or services and reimburse the customer without delay for consideration received. This right of self-delivery only applies if CHANNOINE has concluded a congruent covering transaction in a timely manner and has itself received late delivery from a supplier due to no fault of its own.

Should an order encompass more than one product, we reserve the right of partial delivery after carefully weighing the situation.

The consumer* has the right of withdrawal in accordance with the “Distance and Off-Premises Transactions Act” (Fern- und Auswärtsgeschäfte-Gesetz, hereafter “FAGG”). The following instruction explains the requirements and effects of withdrawing from an order:

*A consumer is any natural person who enters into a transaction for a purpose that cannot be attributed to the person’s commercial or self-employed activity.

To remain in compliance with the withdrawal deadline, it is sufficient to send your notice of withdrawal prior to expiration of the withdrawal period.

Exceptions to the Right of Withdrawal

With respect to statutory exceptions to the right of withdrawal, CHANNOINE applies the following exception:

“Sealed goods that are not suitable for return due to health protection or hygiene reasons if the seal has been removed after delivery.”

Effects of Withdrawing

If you withdraw from this contract, we shall refund to you all payments that we have received from you including the delivery costs (with the exception of additional costs resulting from your choosing a form of delivery other than the standard, least expensive delivery offered by us) promptly and no later than within 14 days from the date on which we received your notice of withdrawal from this contract. For such repayment, we shall use the same payment method that you used for the original transaction, unless we explicitly agree otherwise with you; under no circumstances will you be charged any fees as a result of such repayment.

We may refuse repayment until we have received the goods from you or until you have submitted proof that you have sent the returned goods, depending on which is sooner.

CHANNOINE exercises the right under the FAGG to not assume the shipping costs for returned goods. The immediate return delivery costs shall be assumed by you. Goods capable of being sent as a package are always returned at one’s own risk.

For returns, CHANNOINE provides every customer with a prepared return delivery form and return address labels. To ensure a fast and trouble-free return transaction for your order, notify us online of your decision to withdraw under MY ACCOUNT – Order Overview and use the forms provided by CHANNOINE, which you can conveniently download in your online customer account after completing the withdrawal notification.

To comply with the withdrawal deadline, return goods must be shipped prior to expiration of the
14-day withdrawal period.

END of Withdrawal Instruction

All products are shipped by mail or parcel service and dispatched within one to three working days.

Deliveries are made only to addresses within the Federal Republic of Germany, the Republic of Austria and Switzerland. Note that selecting the “country of ordering” also determines your delivery address. Deliveries can only be made within the country that you have selected; cross-border deliveries are not possible.

CHANNOINE is entitled to partial delivery, to the extent that partial delivery is reasonable for the customer. Additional shipment costs arising from partial delivery are only incurred by the customer if this is explicitly agreed to between CHANNOINE and the customer. Unless otherwise agreed to, deliveries are made ex stock using the customer’s selected mode of shipment.

The products are insured during transport. If products are damaged during transport, CHANNOINE shall replace them.

CHANNOINE shall not be held responsible in the event of negligence by third parties.

Effects of Delayed Delivery

CHANNOINE shall not be held responsible for delivery obstructions that lie within the scope of sub-suppliers and manufacturers. Should delivery or meeting the agreed to delivery time become impossible due to circumstances out of our control, CHANNOINE’s obligation to deliver shall expire and you will be promptly notified of such. As a result, CHANNOINE is entitled to partially or entirely withdraw from the contract if non-attributable delivery obstacles occur (force majeure). In such case, claims for damages are excluded.

All prices quoted in the Web Shop are final prices in the respective national currency (euros for Germany and Austria; Swiss francs for Switzerland) including the applicable value added tax (VAT) but excluding delivery costs (i.e., shipping or carriage costs).

The shipping costs are adjusted from time to time and depend on the ordered products, size of the order and mode of payment. The applicable shipping costs appear in the order overview and should be checked by the customer prior to concluding a binding online order. The costs are also provided in detail in the order acknowledgement sent to the customers by e-mail.

Shipping costs for deliveries to the address specified during ordering:

CHANNOINE assumes the shipping costs for orders with a minimum purchase value of € 100.00 (incl. VAT) or CHF 120.00 (incl. VAT). For orders below € 100.00 (incl. VAT) or CHF 120.00 (incl. VAT) customers are charged € 4.50 (incl. VAT) or CHF 6.00 (incl. VAT) respectively as a “delivery contribution.” The charges for “cash on delivery” (COD) orders are € 4.28 (incl. VAT) for Germany, € 4.20 (incl. VAT) for Austria and CHF 6.00 (incl. VAT) for Switzerland.

VISA/MASTERCARD (3-D Secure)

For payment by credit card you will be automatically forwarded to our secure card payment system operated by Ingenico Payment Services GmbH, where you will send your personal credit card information over a secure SSL line. After a positive credit check and approval by the financial institution, the payment will be promptly processed and the goods will be shipped at the latest on the next working day, based on availability.

3-D secure (the collective term for secure payment processes like Verified by Visa and MasterCard SecureCode) offers practical advantages: You can use it to make secure payments on the Internet and at the same time, as the card holder, receive access to diverse online services of your credit card provider.

This is how payment is made using 3-D Secure:

  1. Place your order at www.channoine.com.
  2. Select “credit card” as the mode of payment and choose either "Visa" or "MasterCard."
  3. Disclose your credit card information (card number, expiration date) to our partner company.
  4. The system recognizes that a 3-D Secure password is registered for your credit card and automatically connects you to the Verified by Visa/MasterCard SecureCode system, which opens a new input mask on your display.
  5. The input mask contains your personal greeting – please verify that it is correct.
  6. Now verify the displayed payment amount.
  7. If both are correct, enter your Verified by Visa password or MasterCard SecureCode.
  8. After confirming your entry, the system checks the data.
  9. If the password or SecureCode is correct, the payment is now processed.

Security Note: CHANNOINE is not informed of your password, only whether the payment has taken place for further processing of your order.

Cash on Delivery

With cash on delivery (COD) as the mode of payment, you pay the invoice amount in cash to the carrier, Deutsche Post, at the time you take delivery of the ordered goods.

Please note that for this mode of payment we charge a COD fee of € 4.28 (incl. VAT) for Germany,
€ 4.20 (incl. VAT) for Austria and CHF 6.00 (incl. VAT) for Switzerland. This fee is contained in the invoice amount.

PayPal

PayPal is a worldwide online payment system that can be used to quickly and securely pay for your purchases. The advantage: Ordering and paying is very convenient – two clicks and you are finished. With PayPal, the invoice amount also reaches us promptly, so we can immediately ship your order if the products are available.

Above all you pay without risk, since you only provide your bank and credit card data once during initial registration with PayPal. After that, you always pay securely with just a few clicks.

CHANNOINE receives real-time confirmation of your payment when you complete the SOFORT transfer, so your order can be processed right away and you can take delivery of it even faster.

SOFORT transfer complies with the high security standards of online banking and is TÜV certified for data privacy. There is no registration and you do not need a credit card. You pay conveniently, securely and fast, directly with your online banking account.

Rebates and Discounts

CHANNOINE does not agree with the widespread practice of granting discounts that have already been calculated into the price anyway. For this reason, we do not grant individual rebates or discounts as a general principle. We regularly inform our customers about combination offers (for example, when buying products that are designed to complement each other) and other special offers in our Web Shop and by newsletter.

The following applies for all modes of payment:

Only after receipt of your payment can we fulfill the order! A delay in payment will delay delivery. The full purchase price, without deductions and including all applicable charges, shall be paid promptly – or at the time of delivery if paying COD. This also applies to partial deliveries, for which the purchase price shall be adjusted accordingly.

CHANNOINE reserves the right to exclude certain modes of payment or to request advance payment on an individual basis and in line with statutory regulations.

Goods remain the property of CHANNOINE until the invoice is paid in full.

CHANNOINE asks that customers in no case send their credit card data by e-mail. Instead, always use the secure pages of the Web Shop to submit personal credit card data.

 

The statutory warranty regulations of the Federal Republic of Germany, the Republic of Austria and Switzerland apply. In addition to these statutory warranties, guarantee provisions accompanying the article may also apply.

In the event that delivered articles show evidence of material or manufacturing defects, including transport damages, customers should immediately notify CHANNOINE or the carrier who delivered the defective articles.

The customer is not required to do so, nor is it a prerequisite for raising a claim, but CHANNOINE cannot otherwise claim damages from the carrier.

Compliance with the aforementioned provision shall not affect the statutory rights of the customer insofar as the order was made as a consumer for private purposes.

Our website may contain links to external Internet sites. We explicitly point out that we have no influence on the content and presentation of such externally linked sites.

CHANNOINE Websites use a tracking tool that collects and saves data for marketing and optimization purposes. For this, we use Google Analytics, a web analysis service of Google Inc. (“Google”). The information generated by cookies regarding your use of this Website is usually transferred by Google Analytics to a Google server in the USA, where it is saved. Ancillary agreements and contract changes must be in writing to be effective. This also applies to revocation of the written form requirement.

If individual provisions of these Terms and Conditions become ineffective or void, this shall not affect the effectiveness of the remaining provisions.
