Scope of validity and definitions

The following General Terms and Conditions (GTC) apply to all business relationships, ...

The website of the CHANNOINE online store is provided as a service by CBS CHANNOINE Business Systems Aktiengesellschaft.

For purchases and/or contracts concluded in Austria or Germany, CBS CHANNOINE Business Systems GmbH, Michael-Walz-Gasse 15, Postfach 200, 5017 Salzburg, Austria (hereinafter referred to as "CBS AT/DE") is the provider and user of these General Terms and Conditions.

For purchases and/or contracts concluded in Switzerland, CBS CHANNOINE Business Systems Aktiengesellschaft, Austrasse 73, Postfach 1, 9490 Vaduz, Liechtenstein (hereinafter referred to as "CBS CH") is the provider and user of these General Terms and Conditions.

Insofar as provisions apply equally to "CBS AT/DE" and "CBS CH", the term "CHANNOINE" is used.

Our products offered via the CHANNOINE online store are aimed exclusively at consumers with unlimited legal capacity as end customers. For the purposes of these General Terms and Conditions, a "consumer" is any natural person who concludes the contract for a purpose that cannot be attributed to their commercial or independent professional activity. Any person who has reached the age of 18 has unlimited legal capacity.

Registration / guest order

Online store orders are possible as a registered customer or in the form of GUEST-orders.

If you would like to order as a registered customer in our online store, you must register before or during the ordering process and provide the personal data that we require to process your order. All mandatory information required for the processing of contracts is marked separately and all other information is voluntary.

Before you can complete your registration, you must agree to the validity of these GTC.

As a registered customer, the personal data you provide will remain stored in your online user account and you can access it again for your next orders without having to enter it again.

If you do not wish to register, you have the option of placing a GUEST order. You must enter all the personal data required to process your order. Once your order has been completed, this data will not be saved for further purchases and no online account will be created. However, after completing your purchase as a GUEST, you have the option of creating a user account and registering.

Point 3

Delivery: Partial deliveries - Delivery times - Delivery restrictions

Your goods will be shipped by:
  • Austrian POST (AT)
  • German POST (DE)
  • Swiss POST (CH)

CHANNOINE is entitled to make partial deliveries insofar as this is reasonable for you. A partial delivery is reasonable in particular if the partial delivery can be used as intended, the delivery of the remaining ordered goods is ensured and you do not incur any significant additional work or additional costs as a result of the partial delivery.

Unless otherwise agreed in individual cases, any deadlines given for the provision of services are approximate. The stated delivery dates are generally non-binding and shall not become part of the contract.

CHANNOINE shall be entitled to withdraw from the contract if the ordered goods are not available despite a correspondingly concluded covering transaction and for reasons for which we are not responsible and we inform you immediately of the non-availability.

In the event of force majeure, the deadline for performance shall be extended appropriately, whereby the duration of the hindrance and a reasonable start-up time shall be taken into account in the assessment. Excluded from this are those cases in which the existence of a case of force majeure and its duration have no influence on the period of service provision. Cases of force majeure also include events that were unforeseeable at the time the contract was concluded, in particular energy and raw material shortages, strikes, lockouts, official measures, pandemics, epidemics, terrorist attacks and war. For the existence of force majeure, it is necessary that the unforeseeable event or its effects do not only last for a short period of time.

In the case of effects that extend over a period of more than five working days, a short-term duration is not to be assumed. We will inform you immediately about the existence of force majeure and the expected end of this circumstance. If the force majeure situation lasts for more than three months without interruption or if the deadline for the provision of services is extended by more than four months due to several force majeure circumstances, both you and we are entitled to withdraw from the contract.

In the event of force majeure, the assertion of claims for damages and other claims is excluded. The obligation to provide consideration shall lapse and any advance payments already made shall be refunded. The provisions of this paragraph shall apply accordingly if the circumstances occur at a subcontractor and affect the delivery to CHANNOINE.

Point 4

Beauty Ambassador

CHANNOINE enables you to become a beauty ambassador and register for this.

Registered beauty ambassadors will receive a thank you from CHANNOINE in the form of a credit note or cash refund for every completed sale on www.channoine.com that can be assigned to the clearly identifiable beauty ambassador. You must specify whether a credit note or cash refund is to be applied when registering as a beauty ambassador and cannot be changed during the ongoing business relationship.

Purchase credit: You will receive 30% of the purchase volume that a person recommended by you achieves within the first 12 months in the CHANNOINE online store using your Beauty Ambassador ID. You can use your 30% referral bonus for your own product orders (only possible in the online store).

Cash reward: You will receive 20% cash value of the purchase volume that a person recommended by you achieves within the first 12 months in the CHANNOINE online store using your Beauty Ambassador ID. We will pay you this bonus either in one lump sum at the end of the annual period - or in installments, which you can call up at any time.

Pricing

All prices listed in the CHANNOINE online store are ...

... are to be understood as final prices in the respective valid national currency (for Germany and Austria in euros, for Switzerland in Swiss francs) including the applicable statutory value added tax and, if applicable, plus any shipping costs incurred.

CHANNOINE shall be entitled to contest the purchase contract in accordance with the statutory provisions if an incorrect price indication is based on an error on the part of CHANNOINE.

The presentation of a product in the CHANNOINE online store is not a binding offer, ...

... but merely an invitation to submit an offer.

You can select items from the CHANNOINE product range, place them in the virtual shopping cart using the "Add to cart" button and can change your product selection in the shopping cart at any time before submitting the order.

Before submitting your order, you can decide whether you want to order as a registered customer or as a guest. As a registered customer, you must log in to your customer account and access the data you have already entered during the rest of the ordering process. If you do not have a customer account, you must register or you can place the order as a GUEST. When registering and ordering as a GUEST, you must enter your personal data, including your name, address and payment method, so that the purchase process can be completed.

Before submitting your order, you will be taken to the order overview, where you can check all the details of your order again.

By clicking on the "Order with obligation to pay" button, you are then submitting an offer to conclude a purchase contract. With your application you immediately accept the CHANNOINE General Terms and Conditions. You will then receive an order confirmation from CHANNOINE by e-mail to check the offer again for correctness and completeness. If you notice a discrepancy with the desired order, please contact CHANNOINE customer service immediately.

The contract is concluded by our final shipping confirmation, which you will receive by e-mail, or by delivery of your ordered items. The purchase contract with consumers is subject to the provisions of the FAGG and the KSchG.

The contractually owed performance is determined by the agreement made, in particular by the shipping confirmation. The agreement of a guarantee or the assumption of a procurement risk must be in writing to be effective.

Shipping costs

The shipping costs are adjusted from time to time and depend on the products ordered, the scope of the order and the payment method. The applicable shipping costs will be displayed in the order overview before the binding conclusion of your online order. In addition, you will also be informed in detail by e-mail when the order is received.

Shipping costs for delivery to the delivery address defined in the order process:

For customer orders that reach a minimum purchase value of € 100.00 (incl. VAT) or CHF 120.00 (incl. VAT), CHANNOINE will pay the shipping costs for your order. For orders under € 100.00 (incl. VAT) or CHF 120.00 (incl. VAT), you will be charged a shipping fee of € 4.50 (incl. VAT) or CHF 6.00 (incl. VAT).

8. Payment

The following options for convenient order settlement are available to you!
Credit cards VISA/MASTERCARD (3-D Secure)

When paying by credit card, you will be automatically forwarded to our secure payment system for credit cards, Planet Merchant Services SAS, where you transmit your personal credit card information via a secure SSL line. Once the credit check has been successfully completed and approved by the bank, payment is made promptly and the goods are dispatched on the next working day at the latest, subject to immediate availability.

3-D Secure (the collective term for secure payment methods such as Verified by Visa and MasterCard SecureCode) offers you practical advantages: You can use it to pay securely on the Internet and, as the cardholder, you also gain access to various "online services" from your credit card provider.

And this is how payment with 3-D Secure works:

  • You place your order at "www.channoine.com".
  • During the payment process, select the payment method "Credit card" and "Visa" or "MasterCard".
  • You provide your card details (card number, expiration date) to the contracting company.
  • The system automatically recognizes the 3-D Secure regulations and a connection to the Verified by Visa/MasterCard SecureCode system is automatically established. Another input screen will open on your screen.
  • The input mask contains your personal greeting: Please first check whether this is correct.
  • Then check the payment amount displayed.
  • If both are correct, enter the required details in the Verified by Visa or MasterCard SecureCode process and carry out 2-factor authentication if necessary.
  • After confirming your entry, the data will be checked by the system and if everything has been verified correctly, the payment will be processed.

Security note: CHANNOINE does not receive any details (password etc.) of your 3-D Secure verification - CHANNOINE only receives the information as to whether the payment can be carried out for further processing of your order.

PayPal

PayPal is the worldwide online payment service that allows you to pay for your purchases very quickly and securely. Your advantage when buying online with PayPal: simply order, pay, done; and all with just a few clicks. With PayPal, we receive your invoice amount promptly so that we can ship the goods immediately if they are available.

„Klarna“

"Klarna" is the direct transfer procedure of SOFORT GmbH. Simple and direct payment via online banking. With "Klarna", you can conveniently transfer the purchase amount to your online banking account while you are still placing your order. CHANNOINE receives a real-time confirmation after your instant bank transfer has been completed. Your order can then be processed immediately and you will receive your purchase even faster.

"Klarna" complies with the high security standards of online banking and has TÜV-certified data protection. You don't need to register or use a credit card. You pay simply, securely and quickly directly with your online bank account.

Apple Pay

To be able to pay the invoice amount via Apple Pay, you must use the "Safari" browser, be registered with the service provider Apple, have activated the Apple Pay function, legitimize yourself with your access data and confirm the payment instruction.

The payment transaction is carried out immediately after the order is placed and CHANNOINE receives the information that further processing of your order can be carried out.

Google Pay

In order to be able to pay the invoice amount via Google Pay, you must be registered with the service provider Google, have activated the Google Pay function, legitimize yourself with your access data and confirm the payment instruction.

Rebates and discounts

CHANNOINE does not follow the widespread practice of granting customers discounts that have already been factored into the prices. For this reason, we do not grant individual rebates or discounts. We regularly inform our customers about special combination offers (e.g. when purchasing coordinated products) or special promotions in our web store and by newsletter.

This applies to all payment methods:

Orders can only be processed once we have received confirmation of your payment! A delay in your payment will delay delivery. CHANNOINE reserves the right to exclude certain payment methods in individual cases within the framework of the statutory provisions or to demand advance payment.

The goods remain the property of CHANNOINE until all invoice items have been paid in full.

CHANNOINE requests all customers not to send credit card details by e-mail under any circumstances, but to enter personal credit card details exclusively in the secure pages of the web store provided for this purpose.

Point 9

Right of withdrawal for consumers

As a consumer you are entitled to ...

BEGINNING OF THE REVOCATION INSTRUCTION

You are entitled to revoke your contractual declaration or a contract that has already been concluded within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which you or a person named by you, who is not the carrier, has taken possession of the goods.

If you as the customer have purchased the goods as part of a single order and these goods are delivered separately, the withdrawal period begins on the day on which you or a person named by you, who is not the carrier, has taken possession of the last goods.

If CHANNOINE has not complied with the obligation to inform you about the existence of the right of withdrawal (conditions, deadlines and procedure for exercising this right), the withdrawal period shall be extended by twelve months.

If CHANNOINE subsequently provides the information within twelve months of taking possession of the goods, or in the case of separate delivery of the last goods, the withdrawal period shall end 14 days after the date on which you received this information.

In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, e-mail or fax). You can use the Sample withdrawal form.pdf available here, but you do not have to do so.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

 

Consequences of withdrawal

If you revoke your contractual declaration or a contract that has already been concluded, CHANNOINE shall reimburse you for all payments that CHANNOINE has received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by CHANNOINE), immediately and at the latest within fourteen days from the day on which you received notification of the revocation of this contract.

For this repayment, CHANNOINE must use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. CHANNOINE is not entitled to charge you any fees for this repayment. However, CHANNOINE is entitled to refuse repayment until CHANNOINE has received the goods back or you have provided proof that you have sent the goods back, whichever is earlier.

You must return the goods to the addresses listed below immediately and in any case within fourteen days at the latest from the day on which you informed CHANNOINE of the revocation of this contract. In the event of your revocation, we will give you the option of returning the goods free of charge. After receiving your revocation, CHANNOINE will provide you with a return label which you can use and on which the appropriate return address is shown. If you do not use the return label, you will have to bear the direct costs of the return shipment. If you have any questions, please contact our customer service at any time.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check their condition, properties and functionality.

Exceptions from revocation

There is no right of withdrawal in the following cases:

  • In the case of a contract for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to the customer's personal needs.
  • In the case of a contract for goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, provided that the seal has been removed after delivery.
  • In the case of a contract for goods that can spoil quickly or whose expiry date would be quickly exceeded.
  • In the case of a contract for goods which, due to their nature, have been inseparably mixed with other goods after delivery.

You are not entitled to legally dispose of the goods until you have acquired ownership and you undertake to inform CHANNOINE immediately if third parties assert rights to the goods.

You will not change products with regard to safety-relevant aspects.

You will not change or remove existing warnings about the dangers of improper use.

If we are obliged to initiate measures, in particular product warnings or product recalls, you will support us to the best of your ability.

Information on online dispute resolution in accordance with the ODR Regulation and Section 36 VSBG

Since February 15, 2016, the EU Commission has been offering a platform ...

Choice of law and jurisdiction

The parties shall replace the invalid or unenforceable provision with a valid and enforceable provision that comes as close as possible to the legal and economic intent of the invalid or unenforceable provision and that they would reasonably have agreed upon if they had considered the invalidity or unenforceability of the respective provision when concluding this contract.
